Terms of Service

These Terms of Service (hereinafter "Terms") govern the legal relationship between Iluehe OÜ (registry code 14642937, hereinafter "WebsiteGenie" or "we") and the client (hereinafter "Client") regarding the services offered through websitegenie.eu.

1. General provisions

The Terms take effect from the moment the Client places an order or enters into a service agreement with us. By placing an order, the Client confirms that they have read these Terms and agree to be bound by them.

2. Service description

WebsiteGenie creates, deploys and maintains websites for small businesses. The Standard package includes:

In addition, we offer optional add-on services (additional pages, multiple languages, custom design, copywriting, etc.) and an optional monthly hosting and maintenance service.

3. Pricing and payment terms

One-time setup fee

The regular price of the Standard 3-language package depends on the legal form:

Introductory prices for new businesses (registered in the Estonian business registry up to 6 months prior to order placement):

Established businesses (over 6 months old) pay the regular price. Add-on services are charged according to the prices on our website or by separate agreement.

Monthly fee (if applicable)

Hosting and maintenance: €15 per month. This fee applies only if WebsiteGenie hosts the Client's website. It includes web hosting, SSL certificate, technical monitoring, backups and one content edit per month. Additional edits from €20.

If the Client already has their own web hosting (e.g. Hostinger, GoDaddy, IONOS or similar), we deploy the site there and no monthly fee applies.

Payment terms

4. Domain and email

The Client obtains their own domain and email service (e.g. via Hostinger, GoDaddy or another registrar). WebsiteGenie helps free of charge with setup and connecting them to the website. The domain always remains owned by and registered in the Client's name.

5. Website creation and approval

  1. The Client submits an order and provides the basic information about their business.
  2. WebsiteGenie creates an initial draft within 24 hours.
  3. The Client reviews the draft and provides feedback (up to 2 rounds of changes are included in the price).
  4. After the Client's approval, the setup fee invoice is issued.
  5. Once the invoice is paid, the website goes live.

6. Termination of the Contract and Refunds

6.1. Website Development (one-off fee)

Before we begin developing the website, we will submit a design draft to you for approval. The one-off fee includes up to two free rounds of revisions to the design draft. After you give your final approval of the design draft and pay the one-off fee, we will begin the technical development of the website. From this point, the provision of the personalised service is considered to have commenced, and the fee is non-refundable (see the exception regarding the consumer's right of withdrawal below).

6.2. Consumer's Right of Withdrawal (applies to you as a private individual)

In accordance with § 53(4)(1) of the Estonian Law of Obligations Act, the 14-day right of withdrawal does not apply to a service that is provided according to your personal requirements. By placing an order, you as a private individual (consumer) give your express consent to begin the provision of the service immediately after the design draft is approved and confirm that you are aware that you thereby lose your statutory right of withdrawal.

6.3. Recurring Packages (Package 2 and Package 3)

You will pay in advance for the selected billing period (1, 3, 6, or 12 months). Advance payments for a period that has already been paid for are non-refundable, even if you decide to stop using the service before the end of the period. The service will remain active for you until the end of the paid period.

6.4. Non-renewal of the Contract

To not renew the contract, you must notify WebsiteGenie of your intention by email before the end of the current billing period. After notification, the service will remain valid until the end of the period already paid for, after which it will terminate automatically and no new invoice will be issued.

Example: If you are on a 3-month package and you notify us of your wish to terminate the contract before the end of the third month, the service will remain valid until the end of that third month, and no new invoice will be issued for the next period.

7. Changes and maintenance

The monthly hosting and maintenance fee covers one content edit per month upon request (e.g. text, phone number or image swap). Additional edits start from €20 each, depending on the scope of work.

Edits are made only by WebsiteGenie to ensure the website's security and technical integrity. The Client does not have direct technical access to website administration.

We typically perform edits within 1–3 business days. Urgent changes are possible by separate arrangement.

8. Consequences of Termination

Upon termination (for non-renewal rules, see §6):

WebsiteGenie may terminate the agreement if the Client materially breaches the Terms (e.g. unpaid invoices over 30 days), with 14 days' notice.

10. Liability

WebsiteGenie makes reasonable efforts to ensure reliable service operation but does not guarantee 100% uptime (e.g. due to third-party hosting, DNS or domain provider outages).

WebsiteGenie's liability towards the Client is limited to an amount equal to the fees paid by the Client during the 12 months preceding the breach. We are not liable for indirect damages, such as lost profits or business disruption. The liability limitation does not apply where damage is caused intentionally or through gross negligence.

11. Intellectual property

Upon full payment of the setup fee, the author's economic rights to the created website (including the source code, texts and design elements) are transferred to the Client. WebsiteGenie retains copyrights to its platform software, general templates and tools.

12. Governing law and dispute resolution

These Terms and the agreement are governed by the law of the Republic of Estonia.

We aim to resolve disputes primarily through negotiation. If negotiations are unsuccessful, the dispute shall be resolved in Harju County Court (Harju Maakohus), Estonia.

13. Changes to the Terms

WebsiteGenie may update the Terms from time to time. We will notify the Client of material changes by email at least 30 days in advance. If the Client does not agree to the changes, they have the right to terminate the agreement before the changes take effect.
